self-evident what happened in benghazi was a terrorist attack. he says the president agrees. quote, it is certainly the case it is in our view that the president's view that it was a terrorist attack. our chief intelligence correspondent katherine heritage what more are we learning. >> reporter: within 24 hours of attack, u.s. intelligence officials believe it was terrorism and the work of a specific group with an al-qaeda affiliate in north africa. there were strong leads that al-qaeda's affiliate working with a second group that wants to make an state. but no one believes that it was just the work of mob. defense secretary telling reporters that benghazi was a terrorist attack that it did take him some time to reach that conclusion. >> reason it pretty clearly was a terrorist group because a

group of terrorists, obviously conducted that attack on the consulate, against individuals. what terrorists were involved i still think remains to be determined by the investigation. >> reporter: a spokesman for the director of national intelligence telling fox that the best intelligence was provided to the administration, updates were also provided as additional intelligence came in and offered a more complete picture of the circumstances. >> shep: two weeks later, f.b.i. hasn't been able to get to the scene of the crime. they haven't been able to get to the city? >> reporter: they say the f.b.i. investigation needs to play out. there are no f.b.i. agents on the ground in benghazi because the security situation is too ten us on. the chairman of homeland security it smacks of a pre-9/11

phone at some point tomorrow. secretary of state hillary clinton is due to be meeting with mr. netanyahu right about now here in new york. also worth pointing out that u.s. intelligence officials have consistently said they believe iran is at least one year away from being able to develop a nuclear weapon and they are not clear that the iranian regime has made the decision to go down that path. >> shep: thank you. mahmoud ahmadinejad also addressed the u.n. today and accused israel of ethnic cleansing. he said that is what the israelis are doing by demolishing homes in east jerusalem. palestinian leader struck a note of optimism in miss comments. >> despite all the complexities of the reality and all what we face in the international community there is a chance, maybe the last to save the

two-state solution and side with peace. >> shep: they don't want to get rid of israel but they wanted a state of their own for palestinians. >> police in minneapolis are searching for a suspect in an office shooting that left two people dead and several others wounded. live pictures the area on the crime scene on the north side of the city. it happened at a company called accent signage systems. according to fox 9 in minneapolis, cops arrived to find the front door propped open and number of victims inside. the suspect was fired from his job this morning and cops know who he is. a hospital says they are treating three victims all of them critical. updates as fox reports live. >> football replacement refs are history. in fact espn reports the

up? >>. >> shep: i think i covered one of these searches 18 years ago. here we are again, the search for jimmy hoffa turned to a driveway in suburban detroit. according to a police chief in roseville, michigan, a man said he saw a body buried there about 35 years ago and he thinks it may have been of the former teamsters boss. why not? he went missing back in 1975. he was last scene seen outside a restaurant before he was set to meet with a local ma yeah captain and labor leader. radar reveals something is under there and they plan to take a soil sample and test it for human remains. still the police chief does not

feel confident. >> we are not saying there is jimmy hoffa but there is possibly a body in this area. it's about the time frame he disappeared but the time frame is off. >> shep: this is not the first time they responded to a tip. they have been following leads an digging up possible burial sites. in 2003 they searched in backyard pool. in 2006 the f.b.i. sent two weeks digging at a horse farm, no hoffa. trace gallagher with the news. police keep saying they don't think it's jimmy hoffa, why all the interest? >> couple reasons, it's one of unsolved mysteries and the cops started this by saying this new witness was credible. they went i.d. this guy but there are reports of dying of cancer and that is why he wants to come clean. first thing he told police, the home in the driveway once

belonged to a bookie for the mob. about the time that jimmy hoffa disappeared he saw a body in a plastic bag being put in the ground where the driveway is. for the most part the cops believe it. listen. >> we do believe there is enough informational we have to do our due diligence and follow-up investigation to see if there is a body in this location and try to find out who that person is and get remains back to their loved ones. >> reporter: kind of risky place to dump a body because it's right around the corner from a police station. >> shep: there is something under that driveway, are they saying what they think it might be? >> reporter: they used ground penetrating radar and dirt was disturbed under the driveway, fancy way of saying there is something down there. it could be a dog. it could be a suitcase. it could be a body. the first thing they'll do is take that soil sample you mentioned and give it to a

certified to make arrests and pleaded guilty to assault and battery charges which leads to the dog. i'm shepard smith. it's the bottom of the hour and fox's top stories. worst drought in more than a century helped drag down the american economy and experts say it could get worse. according to the u.s. commerce department economy drew 3.1%. that is lower than the government's of -- 1.3% and that is lower than 1.7%. the drought and consumer spending contributed to the drop in the rate of economic growth. some analysts say the drought will continue to hurt the economy for months. republicans claim the numbers show that the president's policies have failed while the white house points out that the economy has grown for a dozen consecutive quarters.

according to a new fox news polls of likely voters, 44% approve of the president's handling of the economy compared to 35% two years ago. john reports is following the romney campaign and live tonight but first, let's get to ed henry live outside the white house. you would think the bad economic news would have the president scrambling? >> especially on top of that economic growth number you mentioned which is very weak, durable goods, that came in. it's down 13.2%. washing machines and things that are supposed to last three years. it was the worst drop since 2009 when we were in recession and president took office. nonetheless, the president is out on the trail to gain the battleground of virginia, basically trying to say, look, this is going to take more time. take a listen. >> during campaign season you

hear a lot about patriotism. you know what? it's time for a new economic patriotism. an economic patriotism rooted in the belief that growing our economy begins with a strong and thriving middle-class. i won't pretend that getting there is easy. the truth is it's going to take a few more years to solve challenges that have built up over decades. >> in addition to the bad news, some of those bad numbers, there are numbers on housing prices, they are up this week. also, kon consumer confidence, it had dropped in august. this fits in the white house narrative they believe that it's turning the corner slowly. >> shep: if our polls mean anything, the white house may have a pointed there because it appears from the polls at least that his narrative is breaking through and he is not getting blame here. >> no doubt. when you look at the latest poll on the question who do you trust more on the economy, president

has an edge, a small one but voters told us 47% of them said we trust the president more, 46% said they trusted mitt romney. if you asked anybody six months ago if you have an incumbent versus a challenger who is making the economy and business background you would expect those numbers to be flipped and certainly for mitt romney to have an edge. he doesn't have an edge on the economy, at least not right now that is tell you why he is trailing in a lot of battleground states. >> shep: president obama and governor romney campaigned in virginia. president was the first won to win that stated. he took aim at governor romney's commented not would to worry about 47% of americans that don't pay income tax and dependent on government and never take personal responsibility for their lives? >> in 2008, 47% of this country did not vote for me. i don't know how many of you out

saying in the state of virginia it could be responsible for the loss of 136,000 jobs and when it came to military readiness and national security, along with the medical needs of the thousands of returning veterans from iraq and afghanistan, it could be a disaster. >> this is a crisis. in this kind of circumstance, given the threats around the world. given the need for employment here, given the need of our veterans, how in the world as commander in chief you could stand by as we shrink our military commitment is something i don't understand and i will reverse it. >> reporter:at the same time. governor picked up the endorsement of 42 medal of honor recipients. >> shep: we're seeing another old video of governor romney? >> from 1985 as bain capital, it was a video presentation where governor romney then just mitt romney was talking about the goals of being bain capital to invest in start-up companies and

then take and manage them and five to eight years and harvest them at a significant profit. obama campaign jumped over the word harvest, it's clear that he was only interested in making profits through bain capital and not interested in creating jobs. here is the response from the romney campaign, saying, quote, in addition to starting new businesses, mitt romney helped build bain capital by turning around broken companies and creating and saving thousands of jobs. we should point out this idea of harvesting is a common term in private equity and venture capital. it usually doesn't happen according to one manager until the company has grown significantly and a lot of jobs created. >> shep: john, that is going. we're less than a week from the first presidential debate. we'll be there in denver next wednesday. then watch bret baier and megyn kelly with prime time coverage. it starts just before 9:00
